In this context, Intengo is considered as the ‘data controller‘ in accordance with the Law on the Protection of Personal Data No. 6698 (’’ LPPD '') and we kindly present this Clarification Text to your attention pursuant to Article 10 of PDPL.

2. Processing Purposes

Your personal data that you provide when you become a member is only processed with your explicit consent or in the presence of one of the legal compliance conditions specified in Article 5/2 of the PDPL.

Your personal data is processed; to fulfill the legal obligations under the Turkish Civil Code No. 4721, the Turkish Code of Obligations No. 6098, the Turkish Commercial Code No. 6102, the Law on the Regulation of Electronic Commerce No. 6563, the Law on the Protection of Consumers No. 6502, the Law on the Protection of Personal Data No. 6698 and the secondary regulations, to establish membership and to resolve the requests and complaints from you by evaluating them, due to the fact that it is clearly stipulated in the laws within the scope of Article 5/2 of the PDPL and it is mandatory for the data controller to fulfill his/her legal obligation and data processing is mandatory for the establishment, use or protection of a right,

to make the bid notifications and all other notifications in accordance with the signed specification or distance sales contract in the e-tenders participated by the bidders due to the necessity of processing the personal data of the parties to the contract, and to determine the highest bidder, to notify the bidder to the owner of the real estate, to transfer the title deed and deliver the official or special information, documents, and all kinds of documents to be sent to the bidders, provided that they are directly related to the establishment and/or execution of a contract in accordance with Article 5/2/c of the PDPL,

to communicate more effectively with you in order to inform you about our new products and services and/or new real estates entering the portfolio, provided that you give explicit consent within the scope of Article 5/1 of the PDPL.

As a rule, Intengo doesn't process any sensitive personal data; however if you have given your blood group and religion information in the identity information you provided, this data is accessed by us only to participate in e-tenders provided that your explicit consent is obtained. Apart from this, your personal data can also be shared after they are concealed.

In addition, after examining the CVs and conducting the interviews, we request various documents from the candidates who apply for work in our company. Since some of these documents contain sensitive personal data within the scope of Article 6 of the PDPL, we ask for explicit consent from our candidates at this point.

3. To whom and what purpose the processed personal data can be transferred

For the purposes stated above, your personal data collected can be transferred to;

• • To the intermediary service providers that Intengo has a contract with for the website https://www.intengo.com/ and whose servers are located in Turkey and/or abroad,
• To the courier companies contracted for the purpose of delivering the necessary documentation to the bidders,
• To the owner of the real estate or movable property offered for sale within the scope of e-tendering to inform and report on the sales processes,
• To the relevant land registry office and notaries and, if necessary, to the relevant official institutions for the purpose of finalizing the sales processes to transfer the title deed.

The relevant person can enjoy the rights below by applying us;

• To learn whether his/her personal data is processed or not,
• To request the relevant information if personal data has been processed,
• To learn the purpose of processing the personal data and whether they are used in line with this purpose,
• To receive information on the third persons to whom the personal data is transferred at home or abroad,
• To request the rectification of the data in the event they are processed incompletely or inaccurately,
• To request the deletion or destruction of personal data in the event that the reasons requiring the processing of personal data are eliminated within the framework of Article 7 of the PDPL,
• To request notification to third parties to whom personal data have been transferred that they have been corrected or that personal data have been deleted and destroyed within the scope of Article 7 of the PDPL in case of incomplete or inaccurate processing of personal data,
• To object to any adverse consequences arising as a result of processed data being analyzed exclusively by automatic systems,
• To claim compensation for the damage arising from the unlawful processing of personal data.

Intengo will conclude your requests within this scope free of charge as soon as possible and within thirty days at the latest depending on the nature of the request and will deliver to you in writing or electronically. However, if the transaction requires an additional cost, the fee in the tariff to be determined by the Personal Data Protection Board may be charged.
